with Kiera Greenslade & Kay Yung from Hybrid Legal

From scope creep to influencer agreements and everything in between, this episode of The Legal Loop dives into the everyday legal pitfalls that creative agencies, influencer marketing companies, and IT managed service providers often face – and how to avoid them.

In conversation with Hybrid’s founder, Ryan Lisk, Kiera Greenslade and Kay Yung offer straight-talking advice that every business owner should hear. Whether you’re drafting your first contract or negotiating with a global brand, this episode is packed with insight.

Here are just a few key takeaways:

1. “No contract? You’re not alone – but it’s a risk.”

Kiera and Kay highlight how common it is for agencies and MSPs to operate on goodwill. While understandable, this leaves your business wide open if expectations aren’t aligned. At best, it’s stressful. At worst, it’s costly.

Tip: If you’re relying on email trails, make sure they’re watertight – and get a proper contract in place as soon as you can.

2. Scope creep is real – and often self-inflicted

Many agencies unintentionally invite scope creep by using vague language in their statements of work.

Tip: Be clear. Define your deliverables. Avoid phrases like “including but not limited to”. And educate your team – especially those writing proposals.

3. Don’t let AI do your talking

Kay and Kiera have seen a growing trend of businesses using AI to draft SOWs. While efficient, it often leads to overpromising and legally binding obligations no one intended to commit to.

Tip: Use AI with caution. Always get a legal review before sending anything out to clients.

4. Influencer contracts: who really owns the content?

Brands often assume they own what influencers create. But unless the contract says otherwise, the influencer likely retains ownership.

Tip: Clarify whether you need a licence or a full assignment – and make sure the terms reflect this. Timing matters too; many campaigns move fast, and your contract needs to keep up.

5. Working with big brands? Don’t just sign

Smaller agencies are often handed lengthy contracts from larger clients and feel powerless to negotiate. But as Kay explains, their legal teams expect some pushback.

Tip: You don’t ask, you don’t get. Even small tweaks can make a big difference – and lawyers can help you spot what matters.

Whether you’re a founder, an account director, or simply the person tasked with ‘sorting the contracts’, this episode is a must-watch.
